Terms of Use

These Terms govern your access to and use of GradeThis.ai. Please read them carefully — by using the service you agree to them.

1. Acceptance of Terms

GradeThis.ai ("GradeThis", "we", "us") is operated by GradeThis, Inc. These Terms of Use form a binding agreement between you and GradeThis, Inc. By creating an account, accessing, or using the service, you agree to be bound by these Terms and by our Privacy Policy. If you are using GradeThis on behalf of an institution or organization, you represent that you have authority to bind that entity, and "you" refers to that entity. If you do not agree, do not use the service.

2. Eligibility and Age Restriction

GradeThis is generally intended for users 13 and older. Children under 13 may use GradeThis only with verifiable written consent from a parent or guardian, consistent with the U.S. Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from a child under 13 without that consent. Users between 13 and the age of legal majority in their jurisdiction may use GradeThis only under the authority and supervision of an institution, educator, or parent/guardian with the right to consent on their behalf. If you believe a child under 13 has provided us personal information without the required consent, contact us at [email protected] and we will delete it.

3. Description of the Service

GradeThis is an AI-assisted grading platform for written and show-your-work assessment. It helps educators process submissions, apply rubrics, review reasoning-level grading, generate feedback, and export results. GradeThis is designed to keep a human in the loop: AI-generated grades and feedback are drafts and suggestions that require instructor review. The instructor remains the final decision-maker for every grade.

4. Accounts and Institutional Use

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. When you upload student work, rosters, or other content, you represent that you have the authority and any necessary rights or consents to do so and to have it processed by GradeThis. For institutional deployments, the institution is the controller of student educational records and is responsible for directing how those records are used within the service.

5. Acceptable Use

You agree not to: • use the service for any unlawful purpose or in violation of any applicable law or regulation; • upload content you do not have the right to upload, or that infringes the rights of others; • attempt to access, probe, or disrupt the service, other accounts, or our infrastructure without authorization; • scrape, reverse engineer, or resell the service except as permitted by law; • misuse AI outputs in a way that violates academic integrity policies or harms students.

6. Your Content and License

You (or your institution) retain ownership of the submissions, rubrics, and other content you upload ("Your Content"). You grant GradeThis a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to provide and improve the service for you, including processing by the AI subprocessors described in our Privacy Policy. We do not sell Your Content, and we do not use student submissions to train third-party foundation models except as permitted by you or your institution.

7. AI and Automated Grading Disclaimer

GradeThis uses artificial intelligence to assist with grading, optical character recognition, rubric application, and feedback. AI output can be incomplete or incorrect. It is provided as a suggestion only and is not a substitute for the professional judgment of a qualified educator. You are responsible for reviewing AI-assisted results before finalizing or relying on them. GradeThis does not guarantee the accuracy, completeness, or fitness of any AI-generated grade or feedback.

8. Billing and Subscriptions

Paid plans and usage-based credits are billed through our payment processor, Stripe. By purchasing a plan you authorize recurring charges for the applicable subscription period until you cancel. Fees are stated at the time of purchase and may change with notice for future periods. Except where required by law, payments are non-refundable. You are responsible for any taxes. Cancellation stops future renewals but does not retroactively refund the current period unless otherwise stated.

9. Intellectual Property

The GradeThis service, including its software, design, models, and trademarks, is owned by GradeThis, Inc. and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to our intellectual property except the limited right to use the service in accordance with these Terms.

10. Disclaimers and Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, GradeThis, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless GradeThis, Inc. and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, Your Content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the service. On termination, your right to use the service ends; sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in California will have exclusive jurisdiction over disputes, except where prohibited by applicable law. International users: if you access GradeThis from outside the United States, including from Saudi Arabia, the United Arab Emirates, Qatar, Bahrain, Kuwait, or the European Union, you may have mandatory consumer or data-protection rights under your local law that cannot be waived, and nothing in these Terms limits those non-waivable rights.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
